Terms of Sale or E-commerce Terms

These Terms and Conditions (“agreement”, “contract”) constitute a legally binding agreement between the customer (“you”) and DJ USE ONLY PTY LTD (ACN 661 906 056) trading as DJ USE ONLY (“us”, “our”, “we”, “DJU”, “DJ Use Only) and apply to the ordering, purchase, fulfilment and delivery of Products (“Goods”) from www.djuseonly.com.au (“website or site”). The website includes all web pages under or forming part of the domain name www.djuseonly.com.au. By placing an order for Product(s) through the website you are bound by these terms and conditions set out below (“E-Commerce Terms”) in addition to the Terms of Use applicable to the website.

Please read them carefully before placing your order. The Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of Products.

Online Purchase Eligibility

You must be eighteen (18) years of age or over to register as a member of the website or purchase product(s)s from the website, which have the capacity to enter into a legally binding agreement with us to purchase Product(s)s through this website. By placing an order through the website, you represent to us that you meet this eligibility requirement, and we will rely on this representation if we accept the order. DJ USE ONLY reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an order to be placed, for any loss or damage DJ USE ONLY may suffer as a result of a transaction entered into by a minor.

You must not use any Products purchased through this website for any illegal or unauthorised use, or to violate any laws in your jurisdiction.

Guests and Member Users

You may access and/or use the website as a guest or as a member. If you wish to become a member of the website, you will need to provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details we may not be able to activate your membership or supply products to you. You agree to keep your membership details current at all times by accessing your account via the website or by contacting us by email info@djuseonly.com.au.

You will receive an email from us as soon as practicable after you create your membership account.We only permit one registration per email address and do not use another members’ account without permission.
You must keep your password safe as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorised use of your password or account.If you forget your password you may click on the relevant link located on the website and we will email you a new password, or you may contact info@djuseonly.com.au.

We reserve the right to terminate a member’s account without notice for any reason whatsoever including without limitation, if you have breached or we suspect you have breached these terms.

Legal Rights

Your purchase of Product(s) will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that the Product(s) must be of acceptable quality, reasonably fit for the purpose that DJ USE ONLY represents they will be fit for, and that the Product(s) will correspond with any relevant description. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

Pricing & taxes

All prices and Delivery Charges, Extra Delivery Charges and Express Delivery Charges quoted are in Australian dollars and are inclusive of GST.

DJ Use Only reserves the right to change the prices of Product(s)s at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by DJ USE ONLY.

In addition to the price for the Product(s)s, you will also need to pay the listed delivery charge (if any) (“Delivery Charge”) for your Selected Delivery Option. Delivery Charge will appear in your shopping cart or quote by us in a separate email.

In addition to the price for the Product(s), you will also need to pay the listed delivery charge $9.99 for any orders under $100 (“Delivery Charge”) for your Selected Delivery Option. Any Delivery Charge will appear in your shopping cart.

We offer free delivery (“free freight”) for orders of $100 or over. In addition to the price for the Product(s)s and the Delivery Charge (if any) you may also need to pay any extra delivery charges which are not shown in your shopping cart but which we incur because you live in very remote area or an area where light aircraft/ barge transport is required, or to which our national courier company does not provide a door-to-door service (“Extra Delivery Charge”). These areas include, without limitation, Christmas Island, Norfolk Island, Roma and Nhulunbuy. Extra Delivery Charge may apply even where the product(s) is shown on the Website as having free delivery. If you live in an area to which an Extra Delivery Charge will apply DJ USE ONLY will contact you before accepting your Order and provide you with a quote for the Extra Delivery Charge. If, within the timescale specified, you do not agree to accept the Extra Delivery Charge, DJ USE ONLY will cancel and refund your Order. DJ USE ONLY will not take payment for your Order until you have confirmed your acceptance of the Extra Delivery Charge.

If you would like to deliver your order by Express Post, Express Post delivery charges will apply (“Express Delivery Charges”). Please contact us by email info@djuseonly.com.au or by phone 07 3189 7900. Express Delivery Charges might need to pay separately through direct bank deposit or through our online website. We will check if your area is eligible for Express Post Service and provide you with a quote for the Express Delivery Charge. If, within the timescale specified, you do not agree to accept or pay the Express Delivery Charge, DJ USE ONLY will send out the order by Standard Post.

By placing an Order you agree to pay the price for the Product(s)s, any Delivery Charge, any Extra Delivery Charge and any Express Delivery Charge.

Placing of Orders

You can place an Order by following the website instructions.

Any order for a Product placed through the Site is an offer by you to purchase a particular Product for the price plus the Delivery Charge (if any) as shown at the time of submission of your order. All orders are subject to confirmation of the availability and price of each Product. We may accept or reject your offer in its absolute discretion. In particular, but without limitation, we may reject Orders for commercial quantities of products, or the requested product(s) is no longer available, or if there is an error in the price or the product(s) description posted on this website.

Each Order that you place will, if accepted by DJ USE ONLY, be a separate and binding agreement between you and DJ USE ONLY with respect to the supply of the relevant product(s)s, in accordance with these Terms and Conditions.

If you place an Order for someone else you must obtain their consent before submitting their personal information and, by placing an Order, you confirm to DJ USE ONLY that you have done this.

We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order. Please check all information carefully when placing an Order. You warrant to DJ USE ONLY that all information provided by you in relation to each Order is complete, true and accurate.

Please check your Order and Selected Delivery Option carefully (including the model number, quantities and colour which you ordered) before submitting it as Orders may not be able to be changed or cancelled once the Order has been accepted by us. We will use reasonable endeavours to cancel or change the Order if it has not already been shipped but makes no representation that it will be able to do this. Please contact us immediately by email info@djuseonly.com.au or phone us.

We might consolidate separate orders if you placed those orders which have not been shipped. If it is unable to consolidate, the order maybe delivered separately and a separate Delivery Charge (if any) may apply to each Order.

When you order more than one item in one Order, all product(s)s for which your Order is accepted at the same time will be dispatched together where practicable. However, in some cases product(s)s may be dispatched separately, for example: where the Product(s)s are of different types; or where the Product(s)s have different availability statuses. We might notice you by email or phone, but make no representation that we will do this. Please note that a Delivery Charge is calculated based on Order Value (except Extra Delivery Charge and Express Delivery Charge) and the Selected Delivery Option. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of your Order information being incomplete or inaccurate or as a result of being unable to change or cancel your Order once it has been accepted by us, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

The transmission of your order or the confirmation of any payment, made through an electronic instruction may not be received by DJ USE ONLY for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications, or the omission or failure of third party website providers or systems. At times the facility to place Orders may not be available, your Order might be unreceived, or lost or misdirected, or delayed.

You must take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system, and contains appropriate protection to prevent damage to your computer system caused by viruses, malicious computer code or other forms of interference.

Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense arising out of or in connection with of any Unreceived Order, or Lost Order, or Misdirected order, or Delayed Order or arising out of or in connection with you accessing the Website, whether in agreement, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

During the checkout process, we provide an estimated delivery or collection timeframe. After your order has been placed and accepted, we will confirm the actual delivery or collection time. Please note that our website may contain typographical errors or other inaccuracies and may not always be complete or current. We reserve the right to correct any errors, inaccuracies or omissions and to update information at any time without prior notice. In the event that information on our website contains errors or inaccuracies, including but not limited to pricing, shipping, payment terms or return policies, we reserve the right to refuse to fulfil any orders placed based on such information.

Payment and Payment methods

We currently accept payment by:

  1. Cash, VisaCard, MasterCard, American Express, UnionPay, Cheque, PayID, Afterpay, Zip Money, Zip Pay for orders placed in store.
  2. Visa, Mastercard, American Express, Discover & Diner, China UnionPay and Japan Credit Bureau for orders placed online.

We use a secure payment gateway from EPOS for in-store and Stripe for online purchases. Payment methods are also subject to the acceptance of those payment gateway companies. DJ USE ONLY have no obligation and no liability to EPOS and Stripe for any loss and damage triggered by them or you or any third party payment service company.

You authorise us to debit the amount that is payable in respect of an accepted order from you in accordance with your nominated payment method. You warrant that you are the authorised credit card holder or user of the relevant payment method. You must not pay, or attempt to pay, for a Product(s) using any fraudulent or unlawful means. We reserve the right to change the payment methods that can be used for Orders at any time in its absolute discretion.

When we requested the change of payment methods, it might be because your financial institution or other payment provider has declined payment; or because your payment card has expired. Where this is the case, we reserve the right to cancel your Order and/or place your Order on hold.

Also, your nominated payment method may trigger our fraud detection systems to detect possible irregularities. In the event that this occurs, we may contact you to confirm additional information (for example, proof of identity documents), or use an alternative payment method, or cancel the transaction.

To the extent permitted by law, we (and our assignees) exclude all liability for any loss or damage suffered or incurred by you (whether directly or indirectly) where a credit card, or PayPal, Zip Money, Zip Pay or Afterpay account is used fraudulently or in an unauthorised manner.

We will endeavour to process online payments within a reasonable time. Your credit card or bank account or third payment method will be billed as soon as your order is placed. We would typically expect to process payments within 1-5 business days.

* Products will only be dispatched after payment is fully cleared and deposited into our bank account. The processing time for Direct Debit, Bank Transfer, or Pay ID is typically within one business day. For most Credit Cards or Apple Pay transactions, the processing time is two business days.

Acceptance or Rejection of an order

When you place an online order you will receive an Order Reference Number via email. We will send you an email containing the details of your order which is acknowledgement that we have received your order, and does not confirm acceptance of your order. We will process payment for your Order when, or shortly after, you place your Order. Your Order is deemed to be accepted by DJ USE ONLY and concludes the contract of sale for product(s)ordered by you, when we issued or emailed a Tax Invoice or Sales invoice or Receipt to you. Product(s) that you have ordered will not be dispatched to you until your payment for the product(s) has cleared. If your payment cannot be processed, your Order will be rejected and we will notify you by email. If we cannot fulfil your order or some items cannot be shipped, we will refund the difference back to your credit card or your original payment method. These refunds may take several business days to appear on your statement depending on the financial institution.

You consent to receive email for the Order Reference Number, or Receipt, or Tax Invoice, or Sales invoice, or order details, or delivery updates or any related contents for your online orders, also which will be emailed to the email address provided by you in relation to the order.

In certain circumstances, We may reject all or any part of your order without liability to you for that rejection if

  1. a Product in that order is not available;
  2. there is an error in the price or the description of the Product(s) posted on the website;
  3. the order triggers fraud prevention protocols;
  4. we believe that to do so is otherwise necessary or expedient

 

If we reject an order placed through the Website, then we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you place the order.

Each order placed for product(s) through the Website that we accept results in a separate binding agreement between you and us for the supply of those product(s).

For each order accepted by us, we will supply the product(s) to you in accordance with your Order subject to receiving payment from you and subject to this agreement.

In the event that DJ USE ONLY cancels your Order having already processed payment, it will refund payment in accordance this agreements. This includes (but is not limited to) where we suspect the transaction has been made without the authority of the credit card holder.

For credit card payment refund which likely to take time effect within between 2-10 days and will depend upon how quickly your issuing bank processes the cancellation. For any other payment method or third party payment service such as PayPal, Zip Money, Zip Pay or Afterpay, the time it takes for the refund to take effect will depend on how quickly the relevant payment provider processes the cancellation.

When you place an Order, DJ USE ONLY may complete a pre-authorization of the full value of the Order. A pre-authorization is a practice of validating electronic transactions by holding the value of the Order unavailable until either the merchant charges the account or the transaction is cancelled. If an Order is cancelled (for example, because our fraud detection system has detected a possible irregularity), any pre-authorization may still appear in your account as a pending transaction for a period of time, which will vary depending on your financial institution (e.g. 7 to 30 days). After such time, the funds will become available again for you to use. 

Cancellation an Orders

DJ USE ONLY reserves the right to cancel all or any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

  1. the product(s) are unable to supply or not available;
  2. there is an error on the Website, for example, in relation to a description, features, specifications, price or image, which was not discovered prior to the Order being accepted;
  3. You do not accept the Extra Delivery Charge;
  4. Your nominated payment method was declined or unable to accept or fraud detection;
  5. an event beyond DJ USE ONLY control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike, pandemic, governmental action or failure of computer systems, means that we are unable to supply the Goods within a reasonable time;
  6. we reasonably believe your order has been placed in breach of these Terms of Sale or E-commerce Terms

 

You may cancel an order (whether it is accepted by us or not) by contacting us by email info@djuseonly.com.au or phone 07 31879 7900 during trading hours at any time prior to the dispatch of that order (as notified to you by email).

We will send you an email notifying you of cancellation whether the cancellation requested is by you or us.
On cancellation of an order, we will refund your payment to you. If we cannot stop the shipment of the order at the time of cancellation, then you will be required to refuse delivery or return the Product(s) in order to receive a refund.

Any Delivery Charges are not refundable and will deduct from your total refund amount if you refuse or reject or cancel the shipment by your decision after dispatched.

We will charge you the actual shipping cost even where the product(s) shown “Free Delivery” if you refuse or reject or cancel the shipment by your decision after being dispatched.

Any refunds resulting from an order cancellation will be processed in accordance with our Return, Exchange & Refund Policy, which is incorporated by reference into these E-Commerce Terms.

Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law) or as expressly set out in these terms and conditions, DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of cancellation of your Order, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

Availability of Product(s)

DJ USE ONLY is dependent upon its Suppliers to provide stock, we cannot guarantee availability at all times. You acknowledge and agree that, from time to time, certain product(s) may be out of stock or unavailable. We reserve the right to withdraw or suspend from sale any product(s) shown on the Website, either temporarily or permanently, at any time without notice to you. After you place an Order, if there are any changes in available inventory and we are unable to fulfil your Order, you will be notified as soon as possible.

Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of the unavailability of any Goods at any time, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

Delivery of Orders

We will deliver or dispatch Product(s) ordered through the Website:

  1. if requested by you at the time of placement of the order; 
  2. to a location (nominated delivery address) within service delivery zones (within Australia, no international delivery), which will be confirmed when we notify you by the order confirmation email;
  3. after payment is made in full, cleared, or approved by the financial institutions, the processing time for Direct Debit, Bank Transfer, or Pay ID is typically within 1 business day. For most Credit Cards or Apple Pay transactions, the processing time is 2 business days.

Where requested, DJ USE ONLY will deliver to PO Boxes or Postal Lockers in Australia where possible based on the size of the Goods. Where it is not possible to deliver the Goods to a PO Box or Postal Locker and you have input a PO Box or Postal Locker as the delivery address when placing your Order, we will contact you to arrange an alternative delivery address.

Our Third Party Delivery Provider:

  1. We might use Australia Post, TNT, Star Track or any third party delivery provider to dispatch your orders. You consent us to disclose your name, phone number, address or any related information for them to provide and fulfil the delivery service for you.
  2. we will send an email which contains your order details, tracking number or a tracking link. Please ensure DJ USE ONLY is in your contact address book to ensure emails are not sent to junk mail or blocked.
  3. There may be delays with the delivery of your order(s) and we encourage you to check their website for delivery status information. We do not guarantee delivery timeframes, and we have no liability for a delay in delivering a product that you order as the timeframe for delivery is impacted by the third party delivery provider or a number of factors outside of our control.
  4. You acknowledge and agree that any person at the nominated delivery address is authorised by you to receive your order. Our third party delivery provider might ask the person accepting delivery from the nominated address to provide name, signature or any documents to verify his or her identity, subject to the delivery service provider practice.
  5. If no one is available to collect your order at the time it is delivered, our third party delivery provider will leave written instructions on how you can collect your order. They might ask you to collect your product(s) from their local depots or they might arrange for re-delivery. A re-delivery charge might apply, we have no liability and will not pay for the re-delivery charge.
  6. If you provide “authority to leave” or select a safe drop for your order delivery, we will leave the product(s) to an agreed place. Risk and title in product(s) pass to you at this time and you will bear the risk of any loss or theft of the product(s). Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law) or as expressly set out in these terms and conditions, DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of DJ USE ONLY leaving the Goods in accordance with any “authority to leave” given by you, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

 

Our Internal (DJ USE ONLY) Courier:

  1. We will contact you to schedule a delivery time and date, this service might apply for Metro Brisbane (50 km within QLD 4032 or Brisbane CBD).
  2. Please note that delivery may be affected by factors outside of our control, such as adverse weather conditions and traffic conditions.
  3. Therefore, we cannot promise delivery will happen on time. Where this happens, we will endeavour to contact you for a new delivery time or date.
  4. If you wish to change the delivery time and date after confirmed, please contact us 24 hours prior to the dispatch of your Order.
  5. Where delivery has been confirmed with you, there may be an additional delivery fee for any second attempted delivery (Re-Delivery Charge) if no person is at the delivery address at the time and date of delivery confirmed.
  6. You acknowledge and agree that any person at the nominated delivery address is authorised by you to receive your order. We might ask the person accepting delivery to provide name, signature or any documents to verify his or her identity.
  7. If you provide “authority to leave” for an unattended delivery, we will leave the product(s) to an agreed place. Our staff member will take a photo of the package with the Premises in the background as proof of delivery. Risk and title in product(s) pass to you at this time and you will bear the risk of any loss or theft of the product(s). Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law) or as expressly set out in these terms and conditions, DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of DJ USE ONLY leaving the Goods in accordance with any “authority to leave” given by you, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

If you require product(s) that you have ordered to be redirected to an address which is not the original Order address, and such product(s) have already been dispatched, but makes no representation that it will be able to do this. We may charge you an additional redirect fee (Re-Direct Charge).

Please note that the estimated delivery time from our website or order confirmation email is an approximate delivery time only and is not a guaranteed delivery time for your Order. We do not guarantee delivery timeframes, and we have no liability for a delay in delivering a product that you order

Click & Collect – Pickup of Product(s) in-store

When you place an order by selecting our Click & Collect option, you may collect Product(s) from in-store.

You can collect your Product(s) after payment is fully cleared and deposited into our bank account. The processing time for Direct Debit, Bank Transfer, or Pay ID is typically within one business day. For most Credit Cards or Apple Pay transactions, the processing time is two business days.

We will contact you to confirm that your order is ready for collection.  All collection estimates are indicative and subject to confirmation by us.

You agree to comply with the collection requirements specified below and such other requirements as are identified when you place your order through the website.

  1. We require the person collecting your order to provide us with a copy of the sales invoice or Order Confirmation Email and proof of that person’s identity or Valid Photo ID, which include Driver’s License, Passport, Proof of Age Card or a Government ID Card, for fraud prevention purposes. The copy will not be used by DJ USE ONLY for any other purpose or disclosed to any person outside.
  2. If you paid using PayPal, you will also need your PayPal Transaction ID;
  3. If the person collecting the order is not the cardholder or purchaser, you will need to contact us to pre-authorize an alternate person or a nominated person to pick-up the product(s).
  4. If the card holder, authorised person or yourself is unable to show us identification for verification checks, then we have the right to refuse collection of Product(s) and we will not provide the Product(s). In this instance, we will contact the person who placed the Order using the contact details provided, also offer you the opportunity to return to the store with the required identification

We will hold your Product(s) for 28 days after notifying you that your order is ready for collection. If you fail to collect the order within 28 days after we notify you that the order is ready for collection, we reserve the right to cancel your order; or have the right to allocate those product(s) to another customer and reorder for you; or hold the Product(s) for a longer period subject to a daily storage fee.

Delay in availability or delivery of Product(s

You agree and acknowledge that:

  1. DJ USE ONLY does not guarantee the dispatch or delivery or availability of product(s) within the estimated delivery times listed for the Delivery Options or the Selected Delivery Option or the Click & Collect for your Order, or any other timeframes otherwise specified by DJ USE ONLY or any of its staff;
  2. stock availability and events outside DJ USE ONLY control (including adverse weather conditions, traffic conditions and governmental action) may cause delays, or in some circumstances, prevent your product(s) from being delivered or available for pick-up in-store;
  3. delays are particularly likely to occur during busy sale periods such as those around Christmas, Easter and public holidays; and
  4. except to the extent expressly set out in these Terms and Conditions or otherwise required by law (including, without limitation, the Australian Consumer Law), neither DJ USE ONLY nor any of its agents will be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of any delay in delivery of the Product(s) to you or delay in the availability of Product(s) for pick up in-store, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

Returns/Faulty or Damaged Product(s)

You should inspect and check the Product(s) on delivery or collection in order to ensure that they are what you ordered; and they are not damaged or faulty.

If a Product is damaged at the time of delivery or collection, then you should inform the courier or refuse to accept delivery of that Product and notify DJ USE ONLY immediately.

If you notice damage to a Product after delivery, you should notify us within 7 days of delivery arrival, please ensure to report any damage with photos of the damages attached in the email and send it to info@djuseonly.com.au.

If you wish to return a Product that is not damaged due to a change of mind, and that was provided to you under these Terms, then you may return the Product in accordance with our Return, Exchange & Refund Policy

While returning Product(s):

  1. please provide DJ USE ONLY with your proof of purchase;
  2. it is a requirement for the fulfilment of refunds, exchanges and warranties that you use your best endeavours to return all out-of-the-box accessories (such as cables, power cords, batteries & manuals) supplied at the time of original purchase. We encourage you to use the original packaging where possible in order to avoid damage in transit.
  3. you must also return any Bonus Offers included with the original purchase.

 

You may not be entitled to a refund or exchange just because any packaging is damaged in transit. The packaging exists to protect the Product(s) themselves. We will not refund the delivery fee where the Product has been delivered to you, unless you are returning a Product because it was damaged, it will be at our own discretion.

Refunds

Where DJ USE ONLY is obliged to refund your payment (due to rejection or cancellation of your order, or for any other reason) and pursuant to these Terms and Conditions, we will use our best endeavours to process your refund in a timely manner.

Refunds will be made by us using your original payment method(s) within 2-10 business days (Monday – Friday 10 am to 4 pm Brisbane time, exclude public holiday). The additional time that it takes for you to actually receive your refund will depend upon how quickly your financial institution or other payment provider processes the refund. Please note that we might provide you a partial refund of your payment for specific product(s) in your Order, any delivery charge is non-refundable.

Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), DJ USE ONLY will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of any delay in you receiving any refund due to you, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

DJ USE ONLY may ask you to provide personal information to us or require you to confirm your personal information to enable us to process any orders placed through the website. You agree to provide us with current, complete and accurate personal information. All your personal information is collected and managed in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

We may collect and hold personal information in order to provide you with the Product(s) and to manage trading accounts. You consent to your personal information being used and/or disclosed for those purposes indicated in relation to the collection of your personal information. For example, you consent to us using and disclosing your personal information for the purposes of sending updated information and other marketing material to you. We agree to use any of your personal information in accordance with our privacy policy.

DJ USE ONLY will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.

To the full extent permitted at law, DJ USE ONLY is not liable for any loss of profit, loss of revenue, loss of business, loss of bargain, loss of savings, loss of data, loss or goodwill, loss of reputation, the cost of obtaining replacement or alternative goods or the cost of other remedial measures, or for any indirect, special, economic or consequential loss, arising in connection with any Order or Account.

Governing Law

These Terms of Sales will be governed by and interpreted in accordance with the laws of Queensland, Australia and you irrevocably submit to the non exclusive jurisdiction of the Courts of Queensland, Australia. If any provision of these terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of this agreement, which will continue in full force and effect.

If you access the website in a jurisdiction other than Queensland, Australia, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply. DJ USE ONLY makes no representations that the content of the website complies with the laws of any country outside Australia. 

Severability

If any part of these terms are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these terms and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and DJ USE ONLY.

Transfer and Assignment

If DJ USE ONLY merges, sells or otherwise changes control of its business or this website to a third-party, we reserve the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that we have collected from you and any agreements it has made with you.

Waiver

The failure by DJ USE ONLY to exercise or enforce any right or provision under these terms will not constitute a waiver of such right or provision. Any waiver of any provision under these terms will only be effective if it is in writing and signed by us.

Disclaimer and Indemnity

(1) To the extent permitted by law, DJ USE ONLY and each of their related bodies corporate exclude all liability to you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to the website including, but not limited to, loss or damage you might suffer as a result of:
(i) errors, mistakes or inaccuracies on the website;
(ii) you acting, or failing to act, on any information contained on or referred to on the website and/or any linked website;
(iii) personal injury or property damage of any kind resulting from your access or use of the website;
(iv) any unauthorised access to or use of the websites secure servers;
(v) any interruption or cessation of transmission to or from the website;
(vi) any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through the website by any third party; and/or
(vii) the quality or fitness for any purpose of any linked sites.

Except as expressly provided in these terms, and to the fullest extent allowed by the law, DJ USE ONLY and its third parties will not be liable for any direct, indirect, special, incidental or consequential damages arising out of your access to or use of the website.

You will at all times indemnify, and keep indemnified, DJ USE ONLY and each of their related bodies corporate, including their directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by any of them arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of, in connection with or in respect of your conduct or breach of these terms.

This clause is not intended to exclude or limit any rights which you may have under the Competition and Consumer Act 2010 (Cth).

General

DJ USE ONLY reserves the right to amend these Terms of Sales or agreement at any time. Any amendment will take effect from the time that it appears on the Website. The Terms of Sales which apply at the time that you place your Order are the agreement or contract which will apply to your Order.

Any provision in this agreement which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise shall be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of this agreement or affecting the validity or enforceability of that provision in any other jurisdiction.
