DJ USE ONLY PTY LTD (DJ Use Only) is promised to protect your privacy, keep your information safe and ensure the security of your data. In order to provide the best shopping experience and shop confidence with us, DJ Use Only is committed to complying with the requirements of the Privacy Act 1988 as amended from time to time (‘Act’). The core requirements of the Act are set out in the Australian Privacy Principles (APPs) which govern how organisations collect, hold, use, manage and disclose personal information. The APPs also give individuals a right to know what information an organisation holds about him or her, and a right to correct it if it is wrong.

This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through our djuseonly.com.au. In this Privacy Policy we, us or our means DJ Use Only PTY LTD.

Personal Information

“Personal Information” has the meaning given to it in the Act. Generally, it includes any information that can be used to personally identify you. This may include your name, address, telephone number, email address and occupation, and information about your dealings with us.

What Personal Information do we collect and hold?

The kinds of personal information that we collect or which we may hold about you may include:

    your DJ Use Only account details, including username;
  • Additional details such as date of birth, gender, age, income, occupation, credit report, payment method if you are buying products using a finance plan in store;
  • information contained on identification documents (such as driving licences, passport) and, in some specific cases, copies of such identification documents, where we require these to verify your identity;
  • information on how you use our products and services;
  • details of products and services we have provided to you and/or that you have enquired about, and our response to you;
  • Feedback information relating to you that you provide to us directly through our website or email us from time to time;
  • your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;
    your Internet Protocol (“IP”) address, server address, domain name and information on your browsing activity when visiting one of our websites;
  • information about your access and use of our website, including through the use of Internet cookies, your communications with our website, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider;
  • additional personal information that you provide to us, directly or indirectly, through your use of our website, associated applications, associated social media platforms and/or accounts from which you permit us to collect information;
  • your user name for social networking sites that you use, to refer to, or in conjunction with, our goods and services;
  • personal preferences or views regarding products and services;
  • video and audio surveillance and recording of you when you visit or pick up from our store;
  • photographic images taken of products (which may also include an image of you) when they are delivered to your home by us or one of our third party delivery contractors
    any other personal information requested by us and/or provided by you or a third party.

Why do we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for a number of purposes connected with our business operations which include but not limited:

  • to enable you to access and use our site;
  • to contact and communicate with you;
  • providing you with products and/or services you have ordered/purchased;
  • dealing with requests, enquiries, complaints, consumer guarantee or warranty claims, and other customer care related activities;
  • payment processing;
    processing a refund or exchange of a product;
  • carrying out certain checks (for example, for our fraud or theft prevention processes, if you wish to open an account with us, obtain credit from us, pick-up goods in-store that have been ordered online);

  • the operation and administration of accounts, subscriptions or memberships that you have with us;
  • for internal record keeping and administrative purposes;

    interacting with companies or organisations with whom DJ Use Only has a business relationship (where you work for, or otherwise represent, such an organisation);
  • reconciling payments due to DJ Use Only from suppliers in relation to goods or services provided to you by those suppliers;
  • purposes relating to any third party acquisition or potential acquisition of an interest in DJ Use Only or its assets;
  • complying with our obligations under agreements with third parties;
  • carrying out day to day surveillance of our stores for operational and security purposes; and
    carrying out any activity in connection with a legal, governmental or regulatory requirement that we have to comply with, or in connection with legal proceedings, crime or fraud prevention, detection or prosecution;
  • to comply with our legal obligations and resolve any disputes that we may have.

 

Documents (including hard copy documents and electronic documents such as emails) which coincidentally contain personal information will also be retained in accordance with DJ Use Only normal document retention practices for accounting, legal and business purposes.


Generally, you have no obligation to provide any personal information requested by us. However, if you choose not to do so where we require this information, we may not be able to provide you with the goods and services that you want or deal with a request, enquiry or complaint that you have.

We retain Personal Information for as long as is necessary for the purpose for which it was collected or in some circumstances for longer periods where extended retention is required by law or regulation, and as necessary in order to defend our legal rights.

How do we collect and hold your Personal Information?

We collect your Personal Information directly from you unless it is unreasonable or impracticable to do so. The personal information we collect in a number of ways including:

  • when you order goods or services from us (either online, in-store or over the telephone);
  • when you collect goods that you have ordered from us, including from online or in-store;
  • when you set up an account with us;
  • when you join a membership program;
  • when you purchase certain products from us;
  • when you request for a refund or exchange of a product;
  • when you provide us your details for customer care purposes;
  • when you access and use of our website;
  • when you submit an enquiry using our website;
  • during conversations and communications between you and our representatives;
  • when you provide online feedback or product reviews;
  • when you publicly comment about us on social media sites (for example so that we can answer questions about our products);
  • when you access our premises; through the video and audio surveillance and recording located in our stores, outside our stores (e.g. in the front entry area of a store) or collection areas (e.g. loading docks, visitor parking);
  • through photographic images taken of products (which may also include an image of you) when they are delivered to your home by us or one of our third party delivery contractors.

The personal information we hold in a number of ways including:

  • as part of customer records and other electronic documents on which personal information is contained which are stored on our information technology systems and servers operated by third parties who provide services to us in connection with our business; and
  • by securely storing hard copy documents on which personal information is contained, at our various premises and using third-party document management and archiving services.

Deal with us anonymously

You can deal with DJ USe Only anonymously (i.e. without identifying yourself). In certain circumstances however, we will ask you to provide personal information because it is required by law or our terms and policies to do so, or because it would not be practicable to deal with you anonymously. These circumstances include where you order product(s) online (including when you collect and pick up from our store), where you apply to purchase product(s) on finance, where you return product(s), when you request refund, where you purchase product(s) to be delivered, when you submit a request, enquiry, complaint, consumer guarantee or warranty claim etc.

Marketing
We may use your personal information that we have collected to promote and market products and services to you, including through methods such as email and text message SMS. We will not use your personal information for marketing purposes where you have opted out of receiving such communications.

Please note that when you create an account with us you agree to subscribe to our marketing communications and your details will be added to our marketing database to receive information relating to our products and services. You may also choose to subscribe to our marketing communications by signing up on our website.

Unsubscribe
You can unsubscribe from our marketing communications at any time in one of the following ways:

Emails: Select the “unsubscribe” option in one of the emails that you’ve received from us to unsubscribe. Please note that if you have an account with DJ Use Only, we may still need to send you information about your account or purchase.
Text Message (SMS): Unsubscribe by texting the stated response word e.g. “STOP” or “OPT-OUT” to the mobile number provided in the SMS we sent you.

Sharing and Disclose of Your Personal Information

DJ Use Only may share, disclose or receive personal information or documents about you, including to or from:

  • organisations that provide services to us in connection with our business, including customer support, warranties, payment processing, administration, archival, data storage, data analytics, hosting, research, mail and delivery, distribution, logistics, marketing, auditing, share registry, consulting, financial and legal advisory, banking, debt collection, fraud/theft prevention and/or identification, security or technical services and the operation and administration of membership programs and the Websites. In some cases these service providers may collect your personal information on our behalf;
  • third party platforms like Facebook, Instagram and Google, in an anonymised form for the purposes of displaying banners, advertising or content based on your personal information or preferences;
  • third parties like Google to enable us to manage information collected from the Websites and perform website analytics;
  • manufacturers and distributors of goods;
    if you return manufacturing faulty goods to DJ Use Only to be repaired or warranty claim, third parties including our manufacturer of the goods and authorised repairers;
  • law enforcement agencies to assist in the prevention, investigation and prosecution of criminal activities;
  • parties involved in any third party acquisition or potential acquisition of an interest in DJ Use Only or its assets;
  • our insurers and insurance brokers;
    if goods you purchase from DJ Use Only are subject to a product recall, the manufacturer or distributor of those goods; and
  • other third parties where you have specifically consented to the disclosure of information to these third parties.

Secure Payment Gateway

DJ Use Only uses a third party secure payment gateway (payment protection provider, which allows for the approval of more legitimate transactions by accurately determining the trustworthiness of every transaction) from Stripe for online purchases and EPOS for in-store purchases, which means no credit card details are seen, collected or stored by DJ Use Only, payments are applied by the payment gateway company used. All application traffic, including payment information, traverses the internet through an encrypted channel. You consent and authorise here to share the personal information to our third party payment gateway. 

Storage and Security of your personal information

We will take reasonable steps to ensure that the personal information that we hold is stored in a secure environment and use industry standard security measures to safeguard and protect your information, in order to prevent misuse, interference and loss and any unauthorised access, modification or disclosure. We will put and store your personal information in a place which is suitable for physical, electronic and managerial procedures to safeguard and secure. We have implemented appropriate processes and techniques (including physical security such as locks and security systems and computer and network security, including firewalls, anti-virus software and passwords). We and our third party service providers take all necessary steps to destroy or permanently de-identify your personal information where it is no longer required and to protect your personal information from loss, misuse and interference and from unauthorised access, modification or disclosure.

However, we cannot 100% guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that the personal information we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

Your rights and controlling your personal information

Choice and consent: Please read this Privacy Policy carefully. By providing personal information to us, you understand we will collect, hold, use and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect your use of this website or the products and/or services offered on or through it.

Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

Restrict: You may choose to restrict the collection or use of your personal information. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us.

Access: You may request details of the personal information that we hold about you (except in certain circumstances set out in the Privacy Act 1988 (Cth) such as granting access would pose a serious threat to the life, health or safety of another person or where such access would unreasonably impact on the privacy of others or if it would result in a breach of confidentiality). An administrative fee AUD$50 may be payable for the provision of such information, you will require your identification before providing your personal information.

Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.

Complaints: If you believe that we have breached the Australian Privacy Principles and wish to make a complaint, please email us info@djuseonly.com.au and provide the full details of the alleged breach. After receiving a complaint, we will consider whether we need any further information from you to properly consider and investigate the complaint, and may request additional information from you. We will endeavour to investigate your complaint and notify you by email of the results within 30 days. If the conclusion of our investigation is that our collection, holding, use or disclosure of your personal information was in breach of the Australian Privacy Principles, we will take steps to remedy the breach as soon as reasonably practicable. If your complaint involves complex matters or requires extensive investigation and consultation, it may not be possible to respond within this timeframe.

Unsubscribe: To unsubscribe from our email database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.

Updating Your Account and Personal Information

Customers have the ability to create their account for our online store, and they can access purchase history, edit or update their personal information directly on our website. Please contact us if you have any questions.

Use of Website and Cookies

When you visit our website to read, browse, download information or transact, our system may record information including:

  • the date and time of your visit to the website;
    your server or IP address;
  • the pages you accessed;
  • how you interact with our website;

Cookies are commonly used by many websites and record the Website Activities. A cookie does not identify individuals personally, but it does identify computers. Customers can manage, erase cookies, block cookies, or receive a warning before a cookie is stored through changing their default settings of browsers, and DJ Use Only is not responsible for the customer’s computer settings. Please note that some parts of the Websites may not function fully for users that disallow or block cookies. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our website with personal information, this information may be linked to the data stored in the cookie.

While we take great care to protect your personal information on the Websites and use data transmission encryption, unfortunately no data transmission over the internet can be 100% guaranteed to be secure and safe. We cannot ensure or warrant the security of any information that you send to us or receive from us online. This is particularly true for information you send to us via email. We have no way of protecting that information until it reaches us. Once we receive your transmission, we use our best efforts to ensure its security in our possession.

Those websites are not governed by this Privacy Policy. We have no liability and obligation for content of, or the privacy practices or policies of, those websites.

Exemptions

We handle personal information relying on exemptions under the Privacy Act 1988 (Cth), for example in relation employee records; related bodies corporate; provision of services to State or Territory authorities; and operations outside Australia relating to personal information of non-Australians.

Any permitted handling of personal information under such exemptions will take priority over this Privacy Policy to the extent of any inconsistency.

Amendments

We may, at any time and at our discretion, vary this Privacy Policy by publishing the amended Privacy Policy on our website without notice. We recommend you check our website regularly to ensure you are aware of our current Privacy Policy.
